To be eligible for Small Business Restructuring, your company must have total liabilities of less than $1 million (excluding employee entitlements secured by the Fair Entitlements Guarantee), all employee entitlements must be up to date, and the company must not have used SBR or simplified liquidation in the past 7 years.

Yes. ATO debt is one of the most common reasons businesses enter SBR. Around 93% of companies in SBR have ATO debt. The restructuring plan can include proposals to reduce and restructure tax debts including GST, PAYG, and superannuation guarantee charges.

If your total liabilities exceed $1 million, you are not eligible for SBR. Alternative options include Voluntary Administration, a Deed of Company Arrangement (DOCA), or an informal workout with creditors. A restructuring practitioner can advise on the best path forward.

Employee entitlements that are secured by the Fair Entitlements Guarantee (FEG) are excluded from the $1 million liability threshold. However, outstanding superannuation guarantee charges and other employee-related debts may count toward the limit.
